Kaplina, Доктор юридичних наук Registration Date 30-01-2026 Organization Yaroslav Mudryi National law university popup.description1 The aim of the fundamental research topic is to clarify and explain the essence of European standards that represent the conceptual content of the fundamental human right to a fair trial, in light of the novelisation of Ukrainian criminal procedural legislation, taking into account the realities of today linked to trends in globalisation and digitalisation, as well as existential threats caused by international armed conflict. This objective requires a thorough rethinking of both the general paradigmatic content of the category of ‘fair trial’ and a substantive analysis of the individual elements of the right to a fair trial guaranteed by Article 6 of the European Convention on Human Rights. This raises, in particular, the necessity to examine theoretical, legal, and practical issues related to special pre-trial investigations and court proceedings, taking into account the conditions and guarantees developed in the legal approaches of the European Court of Human Rights regarding criminal proceedings in absentia. In the context of the full-scale invasion and the legislative amendments implemented in response to it, particular attention should be paid to problematic aspects of compliance with the right to effective defence in the wide sense, which is an integral part of the right to a fair trial and is enshrined in Article 6(3) of the European Convention on Human Rights. This indicates an obvious need for scientific reflection and theoretical and practical review of the provisions of the current criminal procedure legislation, as well as for identifying prospective vectors for its development and improvement in light of today's challenges, to ensure that the right to a fair trial is guaranteed in line with European standards. This will allow to formulate theoretical and practical recommendations for improving the national criminal procedural legislation and the practice of its implementation, taking into consideration the current trends. popup.nrat_date 2026-01-30 Close
