The subject of research is patent fees to be collected as a payments for granting and protection of industrial property rights in Ukraine.The object of research is to study the possibility of levelling two scales of patent fees currently in force in Ukraine. Those are presented in ukrainian hryvna and USD correspondly for domestic and foreign applicants. The method of research is statistical analysis of industrial property economy data. Since 1996 as a base for calculation of patent fee rates there have been used a monetary ersatz in the form of Untaxed Minimum of Citizen's Income (UMCI), which amount have not once been indexed. For the period 1996-2001 the real cost of UMCI have been reduced more than three times. Current situation causes serious difficulties in maintenance and further development of industrial property system in Ukraine. First of all this is revealed in increasing ratio of cost of patent servicesto be granted in "dollar" and "hryvna" scales. Since 1996 till 2000 aforementioned ratio have been risen from 4.76 to 13.85. In order to improve existing situation it is necessary to abandon UMCI-index as a base for calculation of fees' amounts. As a result of the research it have been found that the cost of a patent production correlates with GDP per capita values in Ukraine in corresponding periods. It have been shown, that relation between cost of patent production and GDP per capita value in the specific period may be described by a linear dependence. However, the levelling rates of two scales may be reached in a thirty years because of low growth rates of Ukrainian GDP that in the nearest years will not exceed 8% according to government's prognosis. This result is inadmissible in the view of support and further development of Ukrainian industrial property system. Harmonizing demands on the equalizing the rates of two scales and needs for development of national industrial property system is possible onlyby decree increasing of patent fees with simultaneously retraining an elasticity of patent services market as applicants. The system of fee reductions is widely used in patent offices of industrially developed countries especially for such category of applicants as natural persons. Recommendations on implementation of proposals concerning further development of industrial property system in Ukraine are worked out.
