The subject of the research is social relations, which arise in the process of creation and activity of the bodies of state power and the relations, concerning the solution of state and legal conflicts. The purpose of the work is to research the problems of the constitutional and legal regulation of the status, creation and functioning of the bodies of state power, their competence and powers, legal aspects of the division of state power and mutual checks and balances between branches of power, solution of state and legal conflicts because the practice of building of Ukrainian statehood for the period of ten years proves the actuality of the process of reformation of the state machinery towards more clear division of powers between the branches of power and ensuring of their interaction and democratization. The methods of the research are analytical, system, structural, logical, comparative and legal, formal andlogical and a comprehensive approach to the research of the problems of formation and development of Ukrainian statehood. The making of analysis of state and legal conflicts is conditioned by the necessity of study of the specific features of the constitutional development of the state, formation of civil society in Ukraine and the role of the state in this process. The typology of the conflicts in state and legal sphere, the dynamics and stages of their development, the ways of solution, prognosing of new conflicts, the management in the conditions of conflict situations is an important and comparatively new direction of scientific research at the present stage. All these factors and the lack of the comprehensive processing of these problems in native legal science prove the actuality of the topic of this research and the importance of the obtained results. The results of the research, recommendations and conclusions of this scientific and research work have been used in preparation of scientific and practical commentary of the Constitution of Ukraine, in the expertise of the draft laws and other acts of law and in the preparation of the monographs, textbooks and manuals.
