Forming and use of complete set of the proper documents which will allow most effectively and it is grounded to protect interests of Government service of highways of Ukraine at presence of court claims in relation to the transport-operating state of highways of the common use at the RTI accomplishing. A research method is analytical, theoretical. An application domain is the use by the specialists of road organizations of Government service of highways of Ukraine at court claims and origin of claims against the transport-operating state of highways of the common use at RTI. Development of recommendations will allow to give to the court documents in accordance with the requirements ofcurrent legislation and ground claims and objections on the lawsuits given in a court.
