The purpose of this study is generalization of the foreign experience of and the development of recommendations pertaining to the improvement of legal regulation of formation and functioning of banking associations in Ukraine. Attaining the given purpose of the scientific research demanded solving the following tasks: - to substantiate the necessity of institutional reformations of the Ukrainian banking system and define methodological conditions of forming and functioning of banking associations. - to generalize and make a comparative analysis of organizational -legal conditions of forming and functioning of banking associations in different legal systems. - to examine legal consequences for Ukraine of introducing foreign experience of forming and functioning of banking associations. - to develop suggestions pertaining to creation of an effective legal system of functioning of banking associations in Ukraine and executing a consolidated supervision of them. The object of research is the process of forming and functioning of banking associations. The subject of research are the legal norms of forming and functioning of banking associations. During the process of carrying out the scientific research such general scientific methods as theoretical generalization and comparison, analysis, system and complex approaches were used .
