The analysis, synthesis, comparison form the methodological basis of the research. The detailed analysis of legal regulation in sphere of lease and concession in Ukraine was carried out. The legal and economic peculiarities of transferring city-owned heat-supplying, water-supplying and sewerage utilities into lease and concession possession were defined. The practice of use of the mentioned legislation in housing and communal services sphere was examined. During the research it has been found out that the specificity of city-owned heat-supplying, water-supplying and sewerage utilities is insufficiently considered by the current legislation of Ukraine on lease and concession of state and municipal property. It has been proven that current procedures of transferring the mentioned utilities into lease and concession possession on the one hand do not guarantee transparent selection of potential leasers and concessionaires, and on the other hand are too difficult to be fulfilled in small settlements. The mechanisms that make "the latent privatization" of objects in lease possible under current legislation were revealed. The need for a law concerning peculiarities of transferring city-owned heat-supplying, water-supplying and sewerage utilities into lease and concession possession was proved. Such a law, it was proved, would protect interests of local communities and create favorable conditions for private investors. On the basis of the research, the draft Law "On Peculiarities of Transferring City-Owned Heat-Supplying, Water-Supplying and Sewerage Utilities into Lease and Concession Possession" was proposed.
