For achieving the abovementioned goal the composite authors set in the work the following tasks: - to investigate legislative and actual preconditions of the creation and operation of the system of registers of capital construction projects; - To determine the methodological facets (aspects) of creation and operation of the system of registers of capital construction projects in the Single Register of objects of the state property. Methods of investigation For the uttermost analysis of the legal security applied for the registering of capital construction projects as well as normative, methodological and technological aspects of creation of the system of registers of capital construction projects and for achievement of the goals of the work, the composite authors used the following methods of investigation: the method of system analysis; historical (historical and legal) and logical methods; functional-analytic approach and method of statistical testing; program-target methods, simulation and synthesis techniques as well as the methods of comparative law and formal logic. Research Results: The present research work is an integrated study of the organizational and legal grounds and methodological aspects of the registering of capital construction projects subsidized by the national and local budgets, physical persons and legal entities in Ukraine. The novelty of the research work is confirmed by disclosure of the following matters: 1) The faults of the data organization were found in the computerized system LEGAL ENTITIES; these faults concerned the registering of capital construction projects of certain types, specifically incomplete construction and projects created by means of the public funds and local budget funds. 2) It was also proposed to register the incomplete construction projects creation of which was financed by the public funds and which were registered in the Technical Inventory Bureau, in the Single Register of objects of the state property, as the adequate capital construction projects i.e. accordingly to Part one 'BUILDING' and Part 2' ENGINEERING STRUCTURES' of the Classifier of the state property instead of the registration of the incomplete construction projects accordingly to Part four 'INCOMPLETE BUILDING' of the Classifier of the state property; 3) It was determined (as a characteristic feature) that after completion of the capital construction projects created with attraction of the public funds, local budget funds and resources of private investors (legal entities and physical persons) and putting them into operation, the State acquires the property right to the share subsidized by the State budget only and not for the whole capital construction project; 4) The problem of the register was revealed in the Single Register of objects of the state property which are partially owned state. 5) For the errors recovery, it was offered to envisage in the Single Register of objects of the state property the registration of state joint share ownership of the capital construction projects. 6) It was established that the current legislation has inadequate legal foundations for the registration of the projects of capital construction which, under the right of property, belongs to the territorial communities; 7) Actual preconditions for creation of the Consolidated Register of the objects of the municipal property were laid out; all projects of the capital construction, belonging to the territorial communities under the right of property, are to be registered in it; 8) It was proposed to create the three-level system of registers of objects of the municipal property, viz: - in the village, settlement, city, district, borough where the local governments were established, it is necessary to create the local registers of objects of the municipal property (local registers of the objects of the municipal property belonging to the territorial community of the village, settlement, city as well as the joint ownership of the territorial communities within the bounds of the district); - in the district, region, city with boroughs where the local governments were established, it is necessary to create the territorial registers of objects of the municipal property (consolidated local registers within the bounds the district, region, city where the local government were created); - to create the Consolidated register of the objects of the municipal property with consolidated information from all territorial registers of objects of the municipal property including information about the capital construction projects created by means of attraction of financial resources of subjects of the municipal and other types of property owned.
