DEVELOPMENT OF STRATEGY OF INTRODUCTION THE NEWEST FINANCIAL TOOLS IN THE MARKETS OF THE CAPITAL TILL 2020. The purpose of research work is introduction of the newest financial tools by means of creation of necessary legal, economic and organizational preconditions to development of financial tools and maintenance of high-grade functioning of the markets of the capital in Ukraine. Methods of research. At the decision of research problems legal and special methods of research, somehow were used the logic and comparative analysis, the legal and economic analysis of interrelations, the factorial analysis, tendencies of development, processing legislative and statutory acts, references. Results of research. Research work is complex research of problems of introduction of the newest financial tools in the markets of the capital, proceeding from the analysis of the current legislation of Ukraine, positions of Instructions of the European Union and the international experience in view of practice of functioning of a national securities market and revealing of obstacles for development of the markets of financial tools. Testifies to novelty of carried out research that in work: (1) For the first time for conditions of Ukraine it is offered: a. To create legal bases for release of the newest financial tools concerning which there is no legislative base, in particular: Ukrainian depositary receipts, short-term (exchange) bonds of the enterprises; simple and double warehouse certificates; derivative financial instruments (derivatives); special state pension bonds, etc.; b. To install additional requirements to separate kinds of actives (financial tools) as to objects of investment of means of memory pension system; c. Ways of improvement of mechanisms of the taxation of operations with financial tools and incomes on them with the purpose of tax stimulation of investments; (2) Development of the questions touching is profound: a. Prospects of release and accommodationof preference shares of different classes (with various volume of the rights) with the purpose of fuller satisfaction of investment preferences of different categories of investors (the state, management, workers, etc.); b. Modification in the legislation on securities and the share market with the purpose of its reduction the Instruction 2004/39/ЕС " About the markets of financial tools "; c. Developments of the market of hypothec securities and its infrastructures (change of the status of the State hypothec establishment, creation of new institutes: hypothec agents, service agents, confidential operating objects of the mortgage); (3) Have received the further development of the offer on: a. To creation of legal bases for reduction in price of an output of the Ukrainian emitters on the market of the capital owing to restriction of the size of the state duty (tax) on registration of release of securities; to refusal of the taxation of means of the investor regarding the issue income paid in favor of the emitter of shares; simplifications of procedure of release of short-term bonds, etc.; b. To maintenance of investment appeal and reliability of financial tools by decrease in risks of the investors (creditors) connected with investment in financial tools of the markets of the capital; c. To introduction of compensatory mechanisms according to positions of the Instruction of EU 97/9/ЕС "About schemes of indemnification to investors "; d.
