The transformation of intellectual capital (knowledge, ideas, experience) into a valuable strategic resource of modern society led to the development and intensification of social relations, connected with creation, commercialization and introduction innovations, and the need building an innovation model of economy determined emergence of a new vector of state law-making - development and adoption regulations, relating to the management of innovation activity, to enhance and direction of innovation processes in the desired direction for the country. Objects of study are the social relations arising in the sphere of legal regulation of innovation activity in Ukraine. The aim and objectives of the study. The aim is to define the conceptual foundations of the codification of innovative legislation of Ukraine and the development of scientifically based recommendations for the implementation of efficient and effective mechanism of legal regulation of relations arising in the functioning of the national innovation system and market of technologies. According to the target outlines the key objectives of the study: 1) to determine the status and identify issues of legal support of innovation activity; 2) to determine the main characteristics, the structure of the national innovation system, forms of interaction between the individual links and the plight legislature to ensure its functioning; 3) to determine the contents of the innovative function of the state; 4) to establish a subject, place and content of the state innovation policy and how to improve its legislative support; 5) to determine the status and problems of legal operation of the technology market as part of the innovation market; 6) to develop measures aimed at the gaps in legal regulation of social relations connected with trafficking of technologies. Methodological basis of this research is the general scientific and special methods of cognition: system-structural analysis, dialectical, historical, legal and dogmatic, formal, logical, legal, simulation, etc. The scientific novelty of this research is to determine the nature and characteristics of relationships that develop in the sphere of innovations, to analyze of existing legal mechanisms for their regulation, and making concrete proposals for improving the existing legislation in the sphere of innovations. Results of the study are to determine the conceptual foundations of the codification of innovative legislation; to ensure the functioning of the national innovation system proposed to develop and adopt innovative Code of Ukraine. Results of the study partially implemented in the educational literature and scientific publications. Using the results of possible future research relevant issues in law, in legislation and in the educational process.
