The target of the paper - study of international law and adaptation of Ukrainian legislation for using of modern technologies in agriculture and bio-energy production in Ukraine. Methodology - monographic and synthetic analysis of the international experience in GM crops using for agriculture and energy production. The evident advantage of GM crops cultivation comparatively to convenient crops is stated because of the decreasing of herbicide pressure per hectare. From the analytical study of ecological results of GM crops' cultivation in the World it is possible to withdraw the conclusion about positive effect for Ukraine from cultivation of GM crops with few new parameters. The most promising direction is the utilization of Bt genetic constructions, which determine the tolerance of the crops for herbicides, for biodiesel production. It is found that OSR, sunflower and soybeans are the most suitable crops for biodiesel production in Ukraine. After increasing of the average yield of the oil crops (for OSR and soybeans - to 3 Mt/Ha) and after optimizing the structure of the cultivated area Ukraine can reach the production level of 12 mln Mt.
