The procedure of the recognition of evidences as inadmissible under the new Criminal procedural code has been defined. It is proposed to extend the list of grounds, fixed in art. 87 of Criminal procedural code, when evidences should be recognized as inadmissible. The classification of the investigatingjudge authorities has been done. It is grounded that the investigating judge has the burden of proof of the elements of the local object of proof during the investigation of the motions about the application measures to ensure criminal proceedings have been formulated.
