Purpose - research and analysis of intellectual property is in the modern terms of development of enterprises. Methods of research - scientific abstraction, analysis, and synthesis of the literature and statistical sources, statistical and mathematical techniques. Certainly, that most part of enterprises in which concentrated highly technological productions, in the general amount of industrial enterprises is on machine-building enterprises. It is exposed, that, the basic source of technological update of enterprises is acquisition of new technologies abroad, the same investing oversea enterprises on their subsequent innovative development. It is suggested to bring in change to the legislation of Ukraine, namely to Law of Ukraine of "O to the guard of rights on an industrial prototype". It is suggested to complement the article 6 p. 5, and to expound him in such release: "Original is an industrial prototype, if his substantial signs are unexpected, individual and stipulate creative character of aesthetically beautiful features of good". The features of nature of right on a sign for commodities and services are analysed. It is exposed, that introduction of developments of management a brand capital, which are directed on the increase of efficiency of functioning of enterprises, will enable bringing in of additional resources expansion of the strategic programs and introduction new, more effective control system by brands.
