Results: Development of theoretical and legal bases of determining damages caused by the misuse of intellectual property. Determined that the grounds of misuse of intellectual property rights is seen as a kind of intellectual or segment of the shadow economy that is subject to the same adverse effects and economic consequences that are inherent in the informal economy. Justification methodological approaches for determination of losses to improve judicial practice, comparison of compensation in violation of intellectual property rights in the EU with the requirements in Ukraine, summarized the experience in compensation using double the size of royalty and losses from the actions of patent trolls and on this theoretical basis developed guidelines for determining damages caused by illegal use of intellectual property, which should compensate the owner of rights offender in the case of contractual obligations and in case of non-contractual (tort) liability in the illegal use of intellectual property .
