In the research is analyzed the legal principles of the analysis of the admissibility of information exchange between enterprises operating in the relevant market; the main characteristics of types of information, forms of exchanges, and also market structures in the context of observance of competition law are disclosed. On the example of concrete cases the European practice of proving and stopping violations of competition law in the form of information exchanges between enterprises that led to the restriction of economic competition was analyzed. Aggravating and mitigating factors for determining responsibility are systematized. The result of the research work is analytical materials on the qualification of violations of competition law in the form of anticompetitive information exchanges between companies operating in the relevant market. According to the results of the study, the draft Recommendation in "Some questions regarding the application of Article 6 of the Law of Ukraine "On the protection of economic competition" have been developed.
