Such an analysis allows, on the basis of existing foreign case-law, to form an adequate understanding of the definition and demonstration of adverse effects on competition caused by these agreements. In total, about thirty foreign cases concerning different markets and different countries were analyzed. The focus was on the experience of developed countries such as the US, UK, France, Germany and others. According to the results of the study, proposals were prepared on how to eliminate the negative effects on competition caused by cross-border and transnational mergers that can be used by the Antimonopoly Committee of Ukraine decision-making bodies. Directions of formation and implementation of competition policy, in the preparation of methodological and information documents for public authorities, in particular: antimonopoly authority should be clearly defined welfare standards, which will be the basis.
