For point sources of surface water pollution, scientifically sound proposals are being developed for the procedure and methodological means of identifying and establishing mixing zones (MZs) for return water, which ensure the transition to a European water quality assurance system in the part regulation of discharge polluting sustances (PS). The sub-institute of RDPof the water legislation of Ukraine and the EU environmental legislation has been identified and investigated as an important environmental legal object. The main constituent of the RDP is considered: MZ of substances with water of water bodies. The analysis of acts of environmental legislation and EU governing documents, legislative and by-laws of water legislation of Ukraine, guidance and methodological documents related to the RDP and MZs has been performed. There were significant differences between the European and Ukrainian environmental and legal requirements for the MZ at the discharge of the PS, errors and shortcomings of the relevant by-laws of Ukrainian water legislation and guidance documents have been identified. Changes and directions of gradual implementation of the European requirements to the PS in the Ukrainian water legislation are proposed.
