The object of the investigation is the ambiguous or controversial practice of courts of various instances that arose in disputes concerning the protection of subjective civil rights and interests of individuals and legal entities. The subject of the study is legal positions, plenum resolutions, letters, generalization of higher specialized courts; plenary resolutions, letters and summaries of Supreme Court jurisprudence; decisions of the Constitutional Court of Ukraine; ECHR decisions; scientific positions on specific issues and disputes. The aim of the project is to identify issues in the jurisprudence in applying the rules of civil law and to formulate common approaches to resolving such disputes in the future, as well as to promote the level of judicial reform.
