The novelty of the research. A more precise designation of "natural" human rights as rights of existence has been proposed; the list of UN’s International Bill of Human Rights has been expanded; the unique role of Professor H. Lauterpacht in the formation of this document has been discovered; new conclusions regarding possible solutions to a number of problems arising in the modern practice of mutual influence of international judicial institutions of the CoE and the EU in the field of human rights have been formulated; proposals for the improvement of human rights has been formulated. Theoretical results of the research consist of improving the theoretical apparatus of general theoretic human rights research (clarifying the definition of fundamental human rights from the point of view of the essence of the research approach, renaming them to the “existential”); specifying H. Lauterpacht's historical contribution to the drafting of the UDHR; defining a general concept of international standards of such human rights; substantiating possible ways of solving problems in the process of mutual influence of the practice of the CoE and EU judicial bodies. Significance of the work. Implementation of the above objective of the conducted provided for optimization of the general methodology of human rights research (to update its theoretical and conceptual apparatus, clarify the general concept and process of formation of international human rights standards and their guarantees and, in light of the findings, to formulate proposals to improve constitutional guarantees of such rights in Ukraine).
