Discussions on the theory of deliberative democracy over the past decade have identified three groups of problems which this theory is facing with, i.e., problems related to the ideals of consent, a neutral state, and a non-antagonisticity of the political. The study thematize the discourse as a socio-reflexive form of clarification of problematic value orientations of society, in particular the study discovers the role of argumentative practices and their place in public discourse as a meta-institution of legitimation of social and political actions, norms and institutions of Ukrainian society. Conceptual to this research is the claim that in modern society the social content of deliberative democracy emerges in the institutionalization of intellectual (argumentative) discourse as a regulative principle of critical check of the reached consensus in society on important issues of its development. The controversial nature of the development of discursive practices and the public square in Ukraine is also revealed. In particular, it is about replacing the communicative action of consensus with a strategic action aimed at achieving particular goals, which creates an opaque quasi-reality of false communications, hidden perlocutives, and simulative discourses amid increasing populist tendencies.
