The main research methods are comparative-analytical, environmental-legal and conceptual analysis. For point sources of surface water pollution, scientifically sound proposals has been developed on the procedure and methodological tools for determining and establishing return water mixing zones (MZ), which allow the transition to the European water quality assurance system in terms of pollutant discharge control. Sub-institutes of the PPD in the water legislation of Ukraine and in the environmental legislation of the EU identified and studied as important ecological and legal objects. Components of the RPD considered such as: the basic legal terms and conceptual apparatus, regulatory standards and requirements for MZ in water bodies where pollutants discharged. Comparative analysis of acts of the ecological legislation and respecting guide documents of the EU, legislative and by-laws of the water legislation of Ukraine, methodical documents concerning RPD and definition of MZ is executed. Significant differences between European and Ukrainian sub-institutes of the RPD, errors and shortcomings of the relevant by-laws of Ukrainian water legislation and Ukrainian methodological documents are find. Changes and directions of step-by-step implementation (approximation) of European requirements for RPD and MZ in Ukrainian water legislation are proposed. Main directions for such changes are the reception of basic EU law terms and concepts and the transition to EU legal regulation of pollutants discharges in order to comply with environmental water quality standards. Scientifically substantiated proposals for relevant changes in Ukrainian environmental legislation are presented.
