The purpose of the work is to determine the main features and directions of the formation of the state system of legal protection of intellectual property in the conditions of European integration processes; research of forms, methods and mechanisms of its implementation from the standpoint of European integration processes and the modern doctrine of intellectual property law; study of the practice of implementation of model laws and EU directives into domestic legislation; analysis of judicial practice of protection of intellectual property rights in civil, criminal and administrative proceedings of Ukraine and EU countries. The main trends in the development of legal protection of objects of intellectual property rights in Ukraine and EU countries are determined, the peculiarities of their legal regime at the national level in various EU countries, the inconsistencies of Ukrainian legislation with international standards are identified, the conceptual foundations of the development of legal protection and protection of intellectual property rights in Ukraine are determined . As a result of the research, theoretical provisions and conceptual approaches were formulated, which should be taken into account in the process of further adaptation and implementation of Ukrainian legislation to the norms of European intellectual property legislation in the aspect of overcoming existing gaps and conflicts in the legal regulation of relations related to the creation, protection and using the results of creative intellectual activity. On the basis of the results of the conducted research, proposals and recommendations of improving Ukrainian legislation were developed, which found their implementation in legislative work, teaching activities.
