The purpose of the work is to improve the current legislation of Ukraine and bring it closer to the requirements of EU law in the field of defense and protection of rights in the civil procedure. Research methods - general scientific and special methods of scientific knowledge were used: during the retrospective analysis of the formation of approaches to the understanding of defense and protection, the historical-logical method was used; Analysis of factual, statistical material, court practice is based on methods of comparison, grouping, analysis and synthesis and other special methods. The practical significance of the obtained results lies in the theoretical justification and development of proposals for amendments to the legislation of Ukraine in the sphere of defense and protection of rights in the civil process.
