Methods. A complex of complementary methods of scientific cognition was used, including methods of decomposition, systematization, and integration; statistical, critical, and comparative analyses. The research results contain an analysis of the process of acquiring intellectual property rights during wartime aggression and thereafter, the implementation of their protection and defense, as well as the existing prospects in this field in conditions of a state of war and post-war reconstruction. An evaluation of the effectiveness of existing mechanisms and legal principles regulating intellectual property in these conditions has been conducted, identifying strengths and weaknesses, and identifying opportunities for improvement. The current state of intellectual property rights protection in the context of digitalization, Industry 4.0, has been analyzed, highlighting the peculiarities and prospects for further development of intellectual property in the era of digitalization. Common obstacles to legal protection of intellectual property in an international dimension have been identified and critically analyzed. The current state of intellectual property rights protection in the fight against piracy, illegal copies, counterfeit goods in Ukraine and the world has been examined. Innovations in the Law of Ukraine "On Copyright and Related Rights" No. 2811-IX dated December 1, 2022, in comparison with the previous analogous Law No. 3792-XII dated December 23, 1993, which is currently obsolete, have been investigated.
