The purpose of the study is to determine the main features and directions of formation, trends and role of intellectual property in the development of digitalization, digital transformation of the economy in the world and in Ukraine. Research of the forms, methods and mechanisms of its implementation from the standpoint of European integration processes and modern doctrine of intellectual property rights; study of the practice of implementing model laws and EU directives into national legislation; analysis of judicial practice of protection of intellectual property rights in civil, criminal and administrative proceedings in Ukraine and the EU; basic principles of Ukraine's "digitalization" policy against the background of global digital trends. The research methods take into account the main trends in the development of legal protection of intellectual property rights in Ukraine and the EU countries, the peculiarities of their legal regime at the national level in different EU countries, the identification of inconsistencies between Ukrainian legislation and international standards; conceptual foundations for the development of legal protection and enforcement of intellectual property rights in Ukraine in the context of digitalization of the economy; formulation of theoretical provisions and conceptual approaches that take into account the processes of further adaptation and implementation of laws and regulations. Based on the results of the research, proposals and recommendations for improving the legislation of Ukraine have been developed, which have been implemented in legislative work, teaching activities, and are the basis for further research on intellectual property issues in the digital economy.
