Research methods: analysis of scientific literature and normative legal acts on intellectual property protection; comparative legal analysis of the legislation of Ukraine and the EU countries; summarization of practical experience in protecting intellectual property objects; predictive-analytical method. The following results were obtained in the course of the study: 1. The dynamics of the growth of the scale of copyright infringement in the digital environment under martial law was analyzed and the main forms of such infringements were identified. 2. The evolution of approaches to the harmonization of copyright law in the EU was studied and existing contradictions in legal regulation between individual member states were identified. 3. A imbalance between the interests of protecting copyright and ensuring access to educational materials in martial law was established. 4. The features of the legal regulation of the use of orphan works in Ukraine and the EU were analyzed and gaps were identified. 5. Proposals were formulated for improving the mechanisms for protecting intellectual property in the context of martial law and post-war reconstruction, taking into account the experience of EU countries.
