In addition, the requirements for the rule of law, guarantees of human rights and freedoms, guidelines for the values ​​and standards of the European Union, announced by the Constitution of Ukraine oblige our state to unconditionally observe the inalienable rights and freedoms of a person, to steadily increase the level of protection of property and personal non-property rights , which are higher than any law or other act of the state. In our country, there is a misconception that the state grants a person rights and determines their scope. It is necessary to rethink this problem, because property and personal non-property rights are natural and should belong to a person by virtue of the fact of his existence. These rights are exercised by a person in the public-private sphere, therefore, he determines for himself the scope of property and personal non-property rights, and the state should only provide him with opportunities for this. The purpose of the study is a comprehensive analysis of the implementation and protection of civil rights and interests through the prism of civil law and civil procedural aspects of determining the legal nature of property and personal non-property rights and their place in civil law.
