The purpose of the study is to improve the conceptual framework for the implementation of European human rights standards, in particular, the legal standards of the Council of Europe and the European Union, into the Ukrainian legal system, and to create effective mechanisms for their implementation in modern national legal practice. The research methods include the philosophical foundations of anthropology and social determinism, structural, systematic, logical, comparative general scientific methods, as well as some special scientific methods (in particular, methods of interpreting legal provisions, generalization of legal practice). To formulate and clarify general concepts, the author uses the dialectical method of ascending from the concrete to the abstract, and identifying the relationship between the general, the particular and the individual, as well as the part and the whole in the social and legal processes under study. A distinctive methodological feature of this study is the use of the so-called needs-based approach, which allows for a true identification of the social essence of the guarantees under consideration. The scientific novelty of the study, its conclusions and results are due to the fact that as a result of this study, a modern adequate categorical and conceptual toolkit for studying the process of implementation of European legal standards of human rights and freedoms in Ukraine has been developed; the concept of effective implementation of EU legal standards on human rights and freedoms in Ukraine has been created, taking into account the specifics of national socio-cultural prerequisites for the implementation of such standards.
