Systemic analysis and comparative legal methods were applied, and the practices of the ECtHR and the Court of Justice of the EU were studied. A conceptual model for balanced implementation of standards was developed, considering Ukrainian realities, and criteria for assessing the proportionality of rights restrictions were proposed. The results contribute to improving human rights protection mechanisms while ensuring public interests and harmonizing national practice with European approaches.
