The foundations for applying a risk-oriented approach to digitalization of criminal proceedings have been developed: the concept of risks has been defined, a typology of risks has been proposed, the characteristics of the risk-oriented approach have been detailed. A strategy for implementing electronic document management in criminal proceedings in Ukraine has been developed. An authorial definition of electronic evidence in criminal proceedings has been proposed as "factual data obtained in accordance with the procedure established by the Criminal Procedure Code of Ukraine, which exist in digital form, are recorded on digital carriers, and are used to establish facts subject to proof in criminal proceedings." The segregation of electronic evidence as a separate procedural source has been prohibited. A classification of electronic evidence has been developed based on its status, degree of protection, location, form, procedure of creation, presence of changes in the evidence, and content of the data. An organizational and legal mechanism has been proposed to bridge the digital divide between the capabilities of parties in criminal proceedings regarding the examination of digital evidence. This includes the establishment of specialized digital data processing centers under the NAAU or bar associations, as well as the Coordination Center for Legal Aid Provision. The mechanism involves: a) joint funding for technical and software resources for analyzing digital evidence; b) creating and maintaining a registry of technical specialists who can support such centers and conduct investigations; c) establishing a secure infrastructure for data storage and processing, protected from external interference.
