This study analyses Ukrainian national legislation and international legal acts regulating the application of international humanitarian law during armed conflict, with a focus on the activities of the Ukrainian National Guard under martial law. It has been established that the basis for ensuring compliance with IHL is international conventions (the Geneva Conventions, the Hague Conventions, the New York Convention), Ukrainian laws, subordinate legislation, and internal documents of the Ministry of Internal Affairs, the National Guard, and the Ministry of Defence of Ukraine. In particular, the key documents are the Geneva Conventions of 1949, the Hague Conventions of 1907, the Law of Ukraine ‘On the National Guard of Ukraine’, Instruction of the Ministry of Defence of Ukraine No. 164 of 23 March 2017, etc. Problems were identified in the methodology for applying IHL, in particular: insufficient integration of IHL norms into tactical planning, inefficiency of the military training system, lack of understanding of the importance of IHL by some commanders, and lack of monitoring systems. The results of a functional audit among NGU military personnel showed that 85% of respondents consider themselves knowledgeable about IHL, but 70% obtain information from informal sources, and 25% are not interested in deepening their knowledge. Based on the results of the study, specific areas for improving the application of IHL during armed conflicts by the Security and Defence Forces of Ukraine have been proposed: harmonisation of national legislation with international legislation, strengthening cooperation with international organisations (ICRC, UN), development of mechanisms to respond to current challenges, improvement of training and creation of systems for monitoring and accountability for violations of IHL norms.
