UNAUTHORIZED ABANDONMENT OF A MILITARY UNIT OR PLACE OF SERVICE; DESERTION; SERVICEMEN; MILITARY SERVICE; EXEMPTION FROM CRIMINAL LIABILITY The object of the study is the content of theoretical and practical problems related to legal responsibility for the unauthorized abandonment of a military unit or place of service (SZCH) by servicemen and their dismissal from it. The purpose of the research is to investigate the need for regulatory, legal and methodological improvement of the activities of management bodies, units and subdivisions of the National Guard of Ukraine, as well as the formation of theoretical and legal foundations for the use of forces and means of the National Guard, the activities of officials during the application of the administrative and legal mechanism for the reinstatement of military servicemen who have voluntarily left military units and subdivisions, administrative bodies and educational institutions. The third stage of the research entails: the need for a systematic study of changes in legislation in order to prepare proposals on ways to implement the administrative and legal mechanism for reinstatement in military service of servicemen of the specified category, providing scientifically based proposals for actions of NSU officials in the event of the return of such servicemen. The purpose of the 3rd stage of the research is a systematic assessment of legislative changes in the part of the addition to Part 5 of Article 401 of the Criminal Code of Ukraine (exemption from criminal liability of servicemen who have committed unauthorized abandonment of a military unit or place of service, desertion), as well as periodic amendments to the Law of Ukraine "On Military Duty and Military Service" dated March 25, 1992 2232-XII in terms of establishing deadlines for the return of servicemen who have committed unauthorized abandonment of a military unit or place of service, desertion.
