Mamutov Institute of Economic and Legal Research of the National Academy of Sciences of Ukraine" popup.description1 Substantiation of scientific approaches to defining the methodological foundations of legislative drafting, taking into account the EU law-making practice and the legal techniques for preparing EU legal acts popup.description2 The object of the study is the system of ideas, concepts and perceptions that characterize legislative drafting as an instrument for ensuring the quality, effectiveness and coherence of legislation, as well as the regulatory capacity of legal acts. The subject of the study comprises the methods and tools of legislative drafting, taking into account the principles and rules of law-making practice in the European Union. It is argued that institutional strengthening of expert support for law-making activities, strict adherence to standards of public consultation, and the introduction of an evidence-based approach at all stages of the life cycle of a normative act will ensure that Ukrainian law-making aligns with the best European practices. The study substantiates, for the first time, the feasibility of introducing a three-level model for the early detection and prevention of legislative omissions, namely: at the stage of law-making planning; at the stage of drafting legislation; and at the stage of constitutional review. Arguments are presented in favour of introducing the «one in, one out» approach into the national law-making system to help reduce the regulatory burden. The need to create conditions for the development of adaptive regulation using the potential of regulatory sandboxes is emphasized. It is proposed to introduce into the law-making process and the law-implementation level a risk-management mechanism actively used in EU policymaking. The study also argues for the need to update the principles of state regulatory policy to bring them closer to the principles of law-making in the EU. It is deemed urgent to supplement the system of law-making principles with the principles of digitalisation and ecological integration. The research findings are summarized in 1 collective monograph; 5 chapters and 1 subsection in collective monographs; 36 articles in scientific journals; 29 abstracts in the proceedings of scientific conferences, seminars and round tables.
