The total volume of the scientific work is 112 pages. The scientific and practical recommendations provide a comprehensive analysis of the criminal law qualification of offences under Article 308 of the Criminal Code of Ukraine, particularly those committed by organised groups and criminal organisations. The legal nature of narcotic drugs, psychotropic substances, and their analogues as the subject of the crime has been examined. Five methods of obtaining narcotic drugs have been systematised: theft, misappropriation, extortion, fraud, and acquisition through abuse of official position. The characteristics of an organised group according to Part 3 of Article 28 of the Criminal Code of Ukraine have been defined. An analysis of 150 court verdicts in Ukraine for 2022–2024 was conducted, which made it possible to identify typical qualification errors and law enforcement trends. It was established that the most common method of acquisition is fraud (95%), the main subject of the crime is methadone (95%), and the predominant type of punishment is suspended sentence (76%).
