During the study, the authors came to the following conclusions. In the context of hybrid threats (armed aggression, disinformation), the state is obliged to ensure an individualized approach to restrictions on human rights, with effective judicial control and appeal mechanisms, in order to avoid the normalization of exceptional conditions and the risks of authoritarian practices. The practice of the ECHR emphasizes the need for independent monitoring to prevent abuses. The institutional capacity of the state depends on a multi-level architecture of rights protection: parliamentary control (the Verkhovna Rada of Ukraine), judicial supervision (the Constitutional Court of Ukraine, courts of general jurisdiction), the role of the Commissioner for Human Rights and independent bodies. Insufficient effectiveness of the mechanisms (normative conflicts, limited access to the courts in the occupied territories) leads to legal uncertainty, which requires a strengthening of the role of civil society and international organizations (the UN, OSCE, Council of Europe) to monitor and compensate for violations.
