Запропоновано внесення змін до законодавчого визначення поняття «джерело підвищеної небезпеки». Приділено увагу особливостям підстав настання відповідальності та суб’єктному складу правовідносин. Досліджено основні положення практики застосування норм цивільного законодавства вказаного інституту. Визначено шляхи вирішення основних проблем інституту відповідальності за шкоду, завдану джерелом підвищеної небезпеки. The problems of legal regulation of liability for damage caused by a source of increased danger has been investigated in the work. The change to the legislative definition of «source of increased danger» has been suggested. The peculiarities of the grounds for prosecute and subject structure of legal relations has been paid attention. The main provisions of practice of application norms of civil legislation this institute has been investigated.
