Розглянуто зміни, які були внесені до Господарського – процесуального кодексу України, стосовно процесу доказування та доказів. The article is devoted to the contemporary issues concerning the process of proof and the concept of evidence in economic law. Commercial courts of Ukraine are considered to be the guarantors in protecting the rights and legitimate interests of business stakeholders. At the same time, an important prerequisite for the adoption of a legitimate and well-founded judicial decision is to establish the factual circumstances of the case, i.e., a certain range of facts the law links the legal consequences with. The afore mentioned circumstances confirm the claims and objections of the parties and play a critical role in the process of proof. Taking into account the principles of equality of all participants in the litigation before the law and the court and the competition of the parties, this institution is an important and necessary element of a fair, impartial and timely disputes resolution related to the conduct of economic activity by the courts. While considering the changes made to the Commercial Procedural Code of Ukraine, attention was paid to the introduction of the Institute of Witnesses as a subsidiary source of evidence, the extension of the list of evidence, and the new order of their submission, the requirements for the submission and research of electronic evidence, examination, etc. Also, the attention has been drawn to the controversial issues in in this area. popup.nrat_date 2025-07-17 Close
