Досліджено дискусійні питання щодо визначення готування як самостійного злочину та підстав кримінальної відповідальності. Висвітлено недоліки та суперечливі моменти щодо призначення покарання за готування до злочину. Проаналізовано встановлення кримінальної відповідальності за готування до злочину в кримінальному законодавстві Республіки Польщі. Висвітлено способи визначення кримінальної відповідальності за готування до злочину в КК Республіки Польщі The article deals with the comparative legal study of criminal responsibility for committing preparation for a criminal offense under the criminal law of Ukraine and the Republic of Poland. The discussion questions concerning the definition of cooking as an independent crime and the grounds were researched criminal liability. Lacks and conflicting appointment points are highlighted punishment for preparing for a crime.
