Приділено увагу позиції Європейського суду з прав людини щодо повноважень держави при контролі за користуваням майном, враховуючи інтереси людини, суспільства та держави. В роботі надані пропозиції щодо переосмислення питань пенсійного забезпечення всіх категорій осіб, для яких скасовано норми щодо пенсійного забезпечення, призначеного за спеціальним законодавством, а не окремими рішеннями Конституційного Суду України визнавати частково неконституційними вищезгадані зміни до пенсійного законодавства The article analyzes the decisions of the Constitutional Court of Ukraine regarding the issue of narrowing the rights of persons who received pensions under special legislation as a result of pension reform. The attention of the position of the European Court of Human Rights on the powers of the state in controlling the users of the property, taking into account the interests of man, society and the state. The paper proposes rethinking the issues of pension provision for all categories of persons for which the provisions on pensions provided for under special legislation have been abolished and not by separate decisions of the Constitutional Court of Ukraine to consider partially unconstitutional the aforementioned amendments to the pension legislation popup.nrat_date 2025-05-12 Close
