Відповідно до ч. 2 ст. 33 зазначеного Закону авторська винагорода визначається у договорі у вигляді відсотків від доходу, отриманого від використання твору, або у вигляді фіксованої суми чи іншим чином, при цьому її ставки не можуть бути нижчими за мінімальні ставки, встановлені Кабінетом Міністрів України. Не зважаючи на закріплення розмірів мінімальних ставок, зазначені платежі мають цивільно-правовий характер. The main type of payment is the amount paid for the use of copyrighted items under copyright agreements. According to Part 2 of Art. 33 of the said Law the author's remuneration shall be determined in the contract as a percentage of the income received from the use of the work, or in the form of a fixed sum or otherwise, whereby its rates may not be lower than the minimum rates set by the Cabinet of Ministers of Ukraine.
