В.М. Корецького НАН України Description У статті досліджено основні напрями удосконалення методології порівняльної історії права в умовах компаративізації юридичної науки. Доведено, що компаративно-історичний підхід включає як базовий компаративно-історичний метод, а їх використання у сфері порівняльної історії права уможливлює пізнавати загальне, особливе і унікальне в історично-правовому розвитку багатоманітних проявів і форм відображення історично-правової дійсності у взаємозв’язку з різними «не правовими» явищами. Обґрунтовано, що компаративно-історичний підхід може залучати можливості антропологічного, гуманістичного, цивілізаційного підходів. The article investigates the main directions of improving the methodology of comparative history of law in terms of comparative legal science. It is proved that the comparative-historical approach includes as a basic comparative-historical method, and their use in the field of comparative history of law allows to know the general, special and unique in historical-legal development of various manifestations and forms of reflection of historical-legal reality in connection with various "Non-legal" phenomena. It is substantiated that the comparative-historical approach can attract the possibilities of anthropological, humanistic, civilizational approaches. popup.nrat_date 2025-05-05 Close
