Дуже важливим у цьому зв’язку є чітке визначення правового статусу підприємця (права, обов’язки та відповідальність). Особливо це значення набувається в умовах формування підприємницького сектора. В Україні підприємництво робить лише перші кроки до формування ефективної економіки. Але з появою нових фінансових відносин з’явилися і нові фінансові правопорушення. А одним із проявів їх є неправомірне використання відомостей, що становлять комерційну таємницю суб’єкта підприємницької діяльності. Along with the recognition of private property rights (freedom of entrepreneurial activity) in the world and the refusal of states to monopolize economic management, a large number of entrepreneurs have emerged. They have acquired the right to carry out in the manner prescribed by law any kind of effective and useful activity. A clear definition of the legal status of the entrepreneur (rights, duties and responsibilities) is very important in this regard. This value is especially important in the context of the formation of the business sector. In Ukraine, entrepreneurship is only taking the first steps towards forming an efficient economy. But with the advent of new financial relationships, new financial offenses have emerged.
