Корецького НАН України Description Стаття присвячена розкриттю теоретичних засад широкого сенсу категорії «цивільний процесуальний статус» як наукової, з урахуванням розвитку засад принципу верховенства права, засад природного права, причому не тільки тих, що реалізуються у межах національної правової системи, а й тих, що отримали широке застосування на міжнародному рівні, зокрема–у практиці ЄСПЛ. Обґрунтовано, що категорія цивільного процесуального статусу може сприйматись як у вузькому, так і у широкому сенсах. У вузькому сенсі ним є закріплена цивільним процесуальним законодавством сукупність цивільних процесуальних прав та цивільних процесуальних обов’язків. У широкому сенсі ним охоплюються також: положення щодо прав людини «jus cogens», актуальні засади принципу верховенства права у цивільному судочинстві. The article is devoted to the disclosure of the theoretical foundations of the broad sense of the category of "civil procedural status" as scientific, taking into account the development of the rule of law, the principles of natural law, not only those implemented within the national legal system but also those international level, in particular - in the practice of the ECtHR. It is substantiated that the category of civil procedural status can be perceived both in the narrow and in in a broad sense. In a narrow sense, it is a set of civil procedural rights and civil procedural obligations enshrined in civil procedural law.
