Закон розмежовує кредити на ті, що підлягають «призупиненню» і ті, що підлягають «анулюванню»; уточнює види майна, яке є предметом застави за кредитами, які підлягають призупиненню або анулюванню; визначає строки та порядок подання позичальником (його представником) заяви та підтвердних документів кредитору про статус зруйнованого або пошкодженого майна; окреслює дії кредитора та позичальника щодо призупинення або анулювання кредитної заборгованості. Стисло розглянемо запропоновані зміни, передбачені Законом. On January 28, 2023, Law No. 2223-IX "On Amendments to the Tax Code of Ukraine and some laws of Ukraine regarding the support of borrowers whose property was destroyed or damaged as a result of the armed aggression of the Russian Federation against Ukraine" (hereinafter referred to as the Law) will enter into force. The law distinguishes between loans subject to "suspension" and those subject to "cancellation"; clarifies the types of property that is the subject of collateral for loans that are subject to suspension or cancellation; determines the terms and procedure for submission by the borrower (his representative) of an application and supporting documents to the creditor about the status of destroyed or damaged property; outlines the actions of the creditor and the borrower regarding the suspension or cancellation of credit debt.
