Окрім цього, криптовалюта не підлягає під кваліфікацію майна, тобто вона не може бути стягнена як штраф за статтею 53 ККУ тощо. Криміналізація правопорушень, пов’язаних з криптовалютами, включається до складу розгляду кіберзлочинів, тобто тих, які скоєні у кіберпросторі. Наразі криптовалюта активно просувається все далі у маси в Україні, через що наша країна є лідером у цій сфері. Не дивлячись на доволі стрімкий розвиток віртуальних активів та їх можливостей для зловживання, Україна не має окремого законодавства, що регулює криптовалютні операції, однак такі дії можуть бути кваліфіковані як порушення ККУ. Cryptocurrencies, like any other type of property, can be used to commit criminal offenses such as fraud, money laundering, terrorist financing and others. In addition, cryptocurrency does not qualify as property, that is, it cannot be charged as a fine under Article 53 of the Criminal Code, etc. The criminalization of offenses related to cryptocurrencies is included in the composition consideration of cybercrimes, that is, those committed in cyberspace. Currently, cryptocurrency is actively moving further and further to the masses in Ukraine, which is why our country is a leader in this field. Despite the rather rapid development of virtual assets and their potential for abuse, Ukraine does not have separate legislation regulating cryptocurrency transactions, however, such actions may be qualified as violations of the Criminal Code. popup.nrat_date 2025-05-12 Close
