Судова правотворчість – це процесуальна необхідність, яка вимагає від суддів урегульовувати цивільно-правові спори навіть тоді, коли норми права або взагалі відсутні, або їх правозастосування носить проблемний характер внаслідок їх правової неузгодженості з фактичними обставинами у справі, встановленими судом під час судового засідання. В той же час, така правотворчість не може носити безмежного характеру. Її змістовно-правовий зміст завжди повинен узгоджуватись як з Конституцією України, так і Загальною декларацією прав людини та Конвенцією про захист прав людини і основоположних свобод. It is substantiated that judicial law-making is not a separate procedural-legal category, which is based solely on the professional knowledge of judges, their practical experience and inner conviction in the correctness and truthfulness of the decisions made by them. Judicial law-making is a procedural necessity that requires judges to settle civil-law disputes even when the rules of law are either absent at all, or their enforcement is problematic due to their legal inconsistency with the actual circumstances of the case established by the court during the court session. At the same time, such law-making cannot be unlimited in nature. Its substantive and legal content must always be consistent with the Constitution of Ukraine, the Universal Declaration of Human Rights and the Convention on the Protection of Human Rights and Fundamental Freedoms. popup.nrat_date 2025-07-17 Close
