Head Kovalenko Ruslan I., Кандидат юридичних наук Registration Date 01-04-2025 Organization Taras Shevchenko National University of Kyiv popup.description1 To analyze the state of social and labor relations in Ukraine and the prospects for improving the legal mechanism for resolving collective labor disputes (conflicts) in collective bargaining agreements. popup.description2 Research methods: the dialectical method was used to study the development of social dialogue concepts, their evolution and interrelation with social processes; the method of semantic analysis was used to clarify the conceptual apparatus, in particular, the definition of the terms “social dialogue”, “collective labor dispute”, “lockout”; the systemic-structural method was used to analyze the system of legal regulation of social dialogue as an integral mechanism; the method of analysis and synthesis was used to study individual elements of social dialogue and their interrelation. Based on the results of the study, the following proposals and recommendations for improving the system of social dialogue in Ukraine are formulated and substantiated. An important area is to implement the experience of EU countries in distinguishing between disputes over rights and interests. Based on the experience of Lithuania, it is proposed to legislate different procedures for resolving such disputes, to define the competence of different bodies to consider them and to establish the specifics of the application of coercive mechanisms for different categories of disputes. A clear distinction between the types of disputes allows to choose the most effective mechanism for their resolution. Implementation of the proposed recommendations will significantly increase the efficiency of the social dialogue system in Ukraine and bring it closer to European standards, while ensuring that national peculiarities and needs are taken into account.
