It was due to today's conditions when the usual methods of resolving legal conflicts are not always effective, as a result of which, as a rule, the interests and needs of one party remain unsatisfied. And even both sides of the conflict. On the other hand, the established tradition of turning to state authorities for every conflict has led to an overload of courts and administrative bodies. A good alternative to improving access to justice and reducing the burden on courts is the use of other dispute resolution methods, in particular, mediation in resolving administrative, civil, labour, economic, financial, legal relations (tax disputes) and protection of intellectual property rights. Regulation of the mediation procedure, determination of the rights and obligations of its participants, and rules for drafting the parties' agreements are the basis for achieving the goals of mediation and ensuring a balance between the institution of conciliation and the country's legal system popup.description2 The project notes that mediation in Ukraine is voluntary in all categories of disputes, which is in line with EU standards and international documents, in particular Directive 2008/52/EC and the Recommendations of the Council of Europe. At the same time, the principle of voluntariness limits the spread of mediation, as the parties do not always have sufficient incentives to choose it over traditional court proceedings. In this context, an approach is proposed that involves classifying disputes taking into account the possibilities of applying mediation, typical parties to disputes, as well as legal and practical limitations. The authors hypothesise that the effective implementation of mediation, taking into account the best practices of EU countries, will contribute to improving access to justice, reducing the burden on the judicial system, and harmonising legal relations in society. The development of a classification of disputes and the identification of typical participants creates the conditions for optimal models of mediation application and allows the principle of voluntariness to be combined with the need to improve the effectiveness of law enforcement. The research materials are of practical value for the training of legal professionals and can be used in law-making activities to improve national legislation, as well as in the professional practice of judges, lawyers, mediators and civil servants.
