In the methodological guidelines, taking into account the provisions of the Criminal Procedure Legislation of Ukraine and international legal instruments, the circumstances subject to proof in the investigation of violations of the laws and customs of war are outlined. The guidelines address issues of proving the circumstances of the commission of the crime, the methods of committing criminal offenses of this category, the circumstances characterizing the subjective element of war crimes, as well as contextual elements, including the nexus between an individual’s actions and the conditions of an armed conflict.
