The purpose of the research is to substantiate the scientific foundations of institutionalization of the local regulatory framework as a basis for spatial planning of rural development in the process of land management
popup.description2
Based on the analysis of scientific sources and current legislation, the author summarizes the current problems of land use within territorial communities, which can be solved through the development of local regulations. The author examines theoretical approaches to the formation of a local regulatory framework governing the exercise of community powers in accordance with national legislation.
The author proposes the concept according to which local regulations should not only consolidate the procedures for land management, but also establish clear rules for their use. Such acts are important tools for ensuring sustainable development of rural areas and increasing legal certainty in land relations.
The existing system of institutional management of spatial planning, in particular through the use of land management, is analyzed. According to Article 25 of the Law of Ukraine “On Land Management”, the main tool in this process is land management documentation developed at the initiative of local councils.
It has been established that most community decisions are limited to the provision of land plots or approval of documentation. At the same time, it is necessary to more actively formulate local regulations on the procedure for land use, its protection, accounting, use for grazing, payment for land and settlement of land disputes. The basis for this is the Constitution of Ukraine, the Law “On Local Self-Government” and other laws regulating the delegated powers of local authorities.
