Київ Due to the lack of a scientifically substantiated and legislatively regulated economic and legal system for the practical manifestation of the declared constitutional property rights of the Ukrainian people to land and its natural resources as natural objects, which de jure are the main national wealth, departmental-monopoly corruption-oligarchic schemes for the appropriation of the nation's capital operate in practice. It has been established that the most significant paradox of the "state-building" of a unitary and indivisible state was the destructive introduction by the procommunist majority of the Verkhovna Rada of Ukraine of three forms of land ownership: "state", "private" and the far-fetched "collective", by means of (divide and conquer) the adoption of the Law of Ukraine "On Forms of Land Ownership" on January 30, 1992. It is proven that the so-called "land and agrarian reform" initiated on the basis of "collective land ownership" is not consciously introduced by state authorities into the current constitutional field of Ukraine - until now, however, on this basis in 2020 the Verkhovna Rada of Ukraine adopted the so-called Law of Ukraine "On the circulation of agricultural lands". It was revealed that the "legislators" in Articles 79 of the LKU and 373 of the CKU substituted the constitutional norm regarding the right to "use" natural objects of the people's property, in other words, "distribution". The ways of resolving existing anti-constitutional problems substantiated in the article have important practical value, since they are related to the victory of the Ukrainian "constitutional land truth" on the "domestic front" and are intended for the implementation, without waiting for the end of the war, of the legislative initiative of the President of Ukraine, people's deputies and the Government of Ukraine. popup.nrat_date 2026-04-23 Close
